A British student who contracted a gastric complaint because of poor hygiene at a Turkish hotel has been awarded compensation. When the illness struck in June 2013, the 20-year-old was holidaying with his mother at Club Sun City Hotel, Olu Deniz.
Gastric condition later confirmed as Giardia Lamblia
Our client's illness was put down to poor food and water hygiene standards at the hotel. At no time during his entire stay did he or his mother eat away from the hotel complex.
Simpson Millar's James Blower said the holiday was the student's last opportunity to go away with his mother before his scheduled departure for a London university.
"Our client fell ill on the 7th day of his holiday, which meant the rest of the 10-night break was completely ruined," James said.
"Our client initially suffered with severe stomach cramps and constipation which continued for the remainder of the holiday."
Upon return to the UK, he experienced profuse watery diarrhoea, vomiting and continuing stomach cramps
"Following a stool sample he was diagnosed with Giardiasis and he continued to suffer residual symptoms for a number of weeks after his holiday," James continued.
"These included severe fatigue, lethargy and weight loss. Our client's bowel habit has still not returned to normal and his ongoing post-infective irritable bowel symptoms are likely to last another 4 years."
After submitting a detailed Letter of Claim, TUI UK Limited acknowledged liability
Noting that our client had booked his holiday on an all-inclusive basis, James said: "The seriousness of the student's illness and his continuing symptoms meant it was essential to obtain medical evidence.
"I think TUI also recognised that there was little evidence to support a denial, so they agreed to deal with the matter amicably.
"Once the medical evidence was complete an offer was put forward to TUI. They responded with a counter offer which our client decided to accept."
Case an example that such illnesses can affect everyone, not just children and older adults
"It also highlights the seriousness of some infections which can be contracted at all-inclusive hotels if the health and hygiene standards are poor."
James concluded that the young man had been very upset that his and his mother's holiday had been ruined. "The Giardia illness and the continuing symptoms affected the rest of his summer holiday and continued to affect him once he had started university in London.
"The settlement went some way to compensating him for the lost holiday and the suffering he was forced to endure."
